Anti-Spam Policy

We want to sure that Notipal is used correctly. This Anti-Spam policy outlines what we believe to be appropriate email notification and marketing behavior. By registering an account and agreeing to our Terms of Service, you are also agreeing to this anti-spam policy.

Permission Requirements

The CAN-SPAM laws cover only a part of what we believe to be appropriate email notification or marketing practices. Notipal user accounts should have the permission of the email address owner to which they are sending emails.

The word "permission" is open to interpretation. Here are some specific scenarios so it’s clear what does and doesn’t constitute permission.

Contact Eligibility & Permission

To send email to anyone through Notipal, you must have clearly obtained their permission to do so via their act of email address submission through the email notification form provided by Notipal for use in your error pages.

You can only email someone who has clearly given you permission to email them specifically about the subject you’re contacting them about (e.g. a return to normal service after an outage has been resolved).

You cannot send spam email. Spam is any email you send to someone who hasn’t given you their direct permission to contact them on the topic of the email.

Anything outside the examples above doesn’t equal permission, but here are some further examples. By using Notipal, you agree not to send to any email address which:

  • You do not have explicit, provable permission to contact in relation to the topic of the email you’re sending.

  • You bought, loaned, rented or in any way acquired from a third party.

  • You haven’t notified within one month of the outage (to which the recipient has requested an email notification) being resolved.

  • You scraped or copy and pasted from the web.

  • You falsely entered as an email address that is eligible for an email notification regarding one of your outages.

Content Inclusion

Every email you send using Notipal must include the name and physical address of the sender. If you’re sending an email for your client, you’ll need to include your client’s details instead.

Behavioral Monitoring

Notipal monitors account activities to ensure you comply with our anti-spam policy. For example:

  1. Until your account has been approved by our system, every email you send may need to be approved.

  2. The Notipal systems will be integrated into the spam reporting systems of renowned ISP’s. If you don’t have permission and someone marks your outgoing emails as spam, we will find out. If your account receives a complaint rate greater than 0.25% of all recipients, your account may be terminated. We take into account false spam reports.

  3. We constantly monitor blacklists and our abuse accounts. We can easily pinpoint who is causing us delivery problems or attracting complaints.

If we discover that you’re emailing people without their permission, we will terminate your account immediately.
